(05-16) 11:07 PDT FRESNO -- Two Modesto men are facing mandatory 20-year prison sentences after being convicted of running a medical-marijuana operation that federal prosecutors labeled a criminal enterprise, authorities said today.

Luke Anthony Scarmazzo, 28, and Ricardo Ruiz Montes, 28, were convicted by a federal jury Fresno on Thursday of conducting a continuing criminal enterprise, growing marijuana and possessing marijuana with the intent to distribute.

The conviction for running a criminal enterprise carries a mandatory sentence of at least 20 years. U.S. District Judge Oliver Wanger is to sentence both men Aug. 4.

Federal officials said the case sends a message to marijuana growers and dealers who believe they are shielded from prosecution

I have been encouraged by many of you to give a periodic update on Sherry’s situation.  There are many who really care about us and want to stay informed about us.  If you would like to get updates, please reply to this email with a short note letting me know that you would like to get updates.  If you do not want periodic updates, just delete this email.  

I believe I have informed you of the conviction and sentencing of 48 months that occurred on Feb. 14th, 2008.  Sherry was in the Atlanta Detention Center in downtown Atlanta for about 2 months.  She is now in a detention center in Lovejoy, GA, which is about 30 minutes south of Atlanta.  We talk with one another everyday; most days we talk twice a day.  Interestingly enough,

In what is becoming an increasingly alarming trend of federalizing local and state law enforcement through grant programs, we see a symptom of this disease flaring up in grand fascist fashion. Operation Sudden Impact took Memphis, TN by storm. The symbolism of this city being selected is pretty obvious; being a municipal city that is more or less in 3 states required cooperation between multiple states. Essentially, the program served as a city-wide anti-crime and anti-terrorism shakedown (in the form of unconstitutional methods such as roadblocks). Over 400 people were arrested, 100 some-odd of which the news claimed were “fugitives”. I’m assuming this meant they had a bench warrant for some reason. Realistically speaking, there were not 100 some-

NEW YORK – A newly disclosed secret memo authored by the Department of Justice's Office of Legal Counsel (OLC) in March 2003 that asserts President Bush has unlimited power to order brutal interrogations of detainees also reveals a radical interpretation of the Constitution's Fourth Amendment protection from unreasonable search and seizure. The memo, declassified yesterday as the result of an American Civil Liberties Union lawsuit, cites a still-secret DOJ memo from 2001 that found that the "Fourth Amendment had no application to domestic military operations."
